Federal Student Financial Aid Penalties for Drug Law Violations
Students convicted of a federal or state offense for selling or possessing illegal drugs may not be eligible for federal student aid (grants, loans, and work-study) if the offense(s) occured simultaneously while the student was enrolled and receiving Title IV federal financial aid. An illegal drug is a controlled substance as defined by the Controlled Substance Act and does not inlcude alcohol or tobacco.
Students may regain eligibility if they successfully complete an approved drug rehabilitation program. A drug rehabilitation program is considered approved if it includes at least two unannounced drug tests and meets one of the following criteria:
- The program is qualified to receive funds directly or indirectly under a federal, state, or local government program;
- The program is adminstered or recognized by a federal, state, or local government agency or court;
- The program is qualified to receive payment directly or indirectly from a federally or state licensed insurance company; or
- The program is adminstered or recognized by a federally or state-licensed hospital, health clinic, or medical doctor.
